Car Safety and Crashworthiness: Manufacturer’s Duties

The principles of product liability provide consumers with some protection against injury from defective products and a means of recovering damages for injuries resulting from the use of defective products. The protection is in general provided by state laws. As a consequence, the nature, extent and procedures connected with this protection vary significantly from state to state.

   

FDA Recalls: An Overview

When a product is defective or harmful to the public, the Food and Drug Administration (FDA) may order or request a recall of the product from the market. Sometimes, the manufacturers of defective products will voluntarily recall the defective product, while other recalls are ordered by the FDA.

   

Billing Dispute Protection under the FCBA and the EFTA

The Fair Credit Billing Act (FCBA) and Electronic Fund Transfer Act (EFTA) were enacted by Congress as a means to protect consumers engaging in mainstream credit and debit card payment technology. The FCBA creates procedures and guidelines for the prompt resolution of billing and other disputes over credit accounts. The EFTA protects against unauthorized transactions and errors on debit accounts or other electronic transfers.

   

Land Sale Scams Covered by ILSFDA

Prompted by an increase in land sale scams in the 1960’s, Congress passed the Interstate Land Sales Full Disclosure Act (ILSFDA) in 1968. Administered by the Federal Department of Housing and Urban Development (HUD).

   

The Role of the FDA in Regulating Cosmetics

The Food, Drug, and Cosmetic Act (FDCA) defines “cosmetic” as an article intended to be applied to the human body for cleansing, beautifying, promoting attractiveness, or altering the appearance without affecting body structure or functions.  Soap, however, is generally not considered a cosmetic.
